Privacy policy of the SGKV e.V.

The protection of personal data is important to the SGKV e.V. as the responsible body for data processing and is fundamentally governed by the Basic Data Protection Regulation [ORDINANCE (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27. April 2016 on the protection of individuals with regard to the processing of personal data, on the free movement of data and repealing Directive 95/46/EG; in the following: DSGVO]. Therefore, the SGKV e.V. collects, processes (storage, modification, transmission, blocking and deletion) and uses personal data only with existing consent or on the basis of a legal basis. It should be noted that when data is transmitted through public networks, the confidentiality of the transmitted data can never be guaranteed. Consequently, complete protection against access to data by third parties is impossible. Nevertheless, the controller will take all reasonable steps to prevent and/or impede third parties from obtaining knowledge of the personal data. According to Articles 13 and 14 EU GDPR, the controller shall provide a data subject whose data it processes with the information referred to in the Articles. This information obligation is fulfilled by the following explanations.

2. Purposes for which personal data are processed

The personal data will be processed for the implementation of the membership relationship and the pursuit of the purpose of the Association (§ 1 of the Articles of Association of the SGKV e.V.), in particular:

• Professional communication with the members of the association
• Invitation to meetings
• Organization of events
• Sending newsletters and surveys
• Collection of contributions
• Provide publicly available information to increase transparency in combined transport.

In addition, personal data will be transmitted in connection with events, including reporting on them on the website of the association, in appearances of the association in social media and to the media as part of the public relations work of the association. Within the framework of the project work of the association, personal data is processed for the communication of the project partners and for the organization of the project work.

3. Type of personal data

Within the scope of necessity for the fulfillment of the contract, the following data are regularly collected and stored:

• Salutation, title, first name, last name
• Corporate affiliation
• Business Address (street, house number, postal code, city)
• Business phone number(s)
• Business email address
• If applicable, business bank details
• Date of joining the association, if applicable

The use of the website of the SGKV e.V. is generally possible without providing personal data. Data collected during the usage process (log files, cookies) are used for statistical evaluation of the use of the Internet presentation of the SGKV e.V. An assignment of the data to the calling user is not possible. The data is not stored together with other personal data of the users.

4. Legal bases on which the processing is based

The processing of personal data is usually based on the necessity for the performance of a contract pursuant to Article 6 (1) b) DSGVO. The contractual relationships are primarily the membership relationship in the association and the participation in events and the cooperation in research projects. If personal data are collected without the processing being necessary for the fulfillment of the contract, the processing is based on consent pursuant to Article 6 (1) a) in conjunction with Article 7 DSGVO. Article 7 DSGVO.The publication of personal data on the Internet or in local, regional or national media is done to protect the legitimate interests of the association (see Article 6 (1) f) DSGVO). The legitimate interest of the Association is to inform the public by reporting on the activities of the Association including research projects. In this context, personal data including pictures of the participants of events are published, for example, in the context of reporting and public relations work.

5. Recipients or categories of recipients of the personal data

The data is stored on the local server of the SGKV e.V. and can only be viewed by authorized persons of the office. The provision of personal data is not required by law. A transfer of personal data to unauthorized third parties does not take place; authorized third parties are in particular public bodies that receive the data due to legal regulations (e.g. tax authorities). Personal data of the members of the association and personal data of other third parties are processed by the office of the association. The data of the bank details of the members will be forwarded to the Berliner Sparkasse for the purpose of collecting contributions.

6. The duration for which the personal data will be stored or, if this is not possible, the criteria for determining the duration

The personal data is stored for the duration of the membership. Upon termination of membership, the data categories are retained for a further ten years in accordance with the statutory retention periods and then deleted. In the period between termination of membership and deletion, the processing of this data is restricted. Certain categories of data are stored for the purpose of the association archive. These are the categories first name, last name, company affiliation and date of joining the association, if available. The storage is based on a legitimate interest of the association in the documentation of the association's history. All data of the other categories (e.g. bank data, address, contact data) will be deleted upon termination of membership in accordance with the retention periods. Personal data of non-members are subject to the same provisions as personal data of members, a storage of personal data is made by legitimate interest of the association in the context of the implementation of project work and the pursuit of the association's purpose. The personal data will only be used for the above purposes. Your personal data will only be stored and processed for the period of time necessary to achieve the purpose of storage or if this has been provided for by the European Directive and Regulation Maker or another legislator in laws or regulations to which the controller is subject.

7. The data subject shall be entitled to the following rights under the conditions set forth in each of the Articles

• the right to information according to Article 15 DSGVO,
• the right to rectification in accordance with Article 16 of the DSGVO,
• the right to erasure in accordance with Article 17 DSGVO,
• the right to restriction of processing pursuant to Article 18 DSGVO,
• the right to data portability according to Article 20 DSGVO,
• the right to object according to Article 21 DSGVO,
• the right to lodge a complaint with a supervisory authority pursuant to Article 77 DSGVO
• the right to revoke consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until revocation.

The consent to the processing of personal data that is not absolutely necessary for the fulfillment of the contract according to membership in the association can be revoked at any time in writing or by e-mail without giving reasons.

8. The source from which the personal data originates

Personal data is generally collected in the course of acquiring membership. Further data is collected in the course of business contacts and the association's project work as well as participation in standardization committees and technical exchanges with companies and authorities.
